E-SIGN CONSENT AGREEMENT

Consent to Receive Electronic Communications and Use of E-Signatures

Home Buyers Resale Warranty Corporation, 2-10 HBW Warranty of California, Inc., 2-10 Home Buyers Warranty of Oklahoma, Inc., 2-10 Home Buyers Warranty of Virginia, Inc., Home Buyers Warranty Corporation VI and each of their respective affiliated companies and third party service providers, including but not limited to Home Buyers Warranty Corporation (collectively “2-10 HBW”, “We”, “Our”, or “Us”) may need to provide You with certain communications, notices, policies, terms of use, privacy notices, agreements, billing statements, and/or disclosures in writing (“Communications”) regarding Your home warranty service agreement(s) and/or Your relationship with 2-10 HBW. Your agreement to this e-sign consent confirms Your ability and consent to receive Communications electronically from Us, rather than in paper form, and to use Electronic Signatures in Our relationship with You (“Consent”). For the purposes of this Consent, “You” or “Your” shall mean the individual(s) providing this Consent, any individual(s) requesting additional information concerning a potential home warranty service agreement in connection herewith and each customer, homeowner, designated contact or other individual identified in connection with a particular home warranty service agreement. When this Consent is provided in connection with documents related to an actual home warranty service agreement(s), You agree that any individual designated as a primary or secondary homeowner in Our records shall have authority to grant or revoke this Consent for all individuals identified in connection with that particular service agreement. An “Electronic Signature” includes any mark, symbol, sound or process that is written, stamped, engraved, attached to or logically associated with an electronic document and executed by a person with the intent to sign.

 

Under this Consent, 2-10 HBW may provide all Communications electronically by email, by text message, or by making them accessible via 2-10 HBW’s websites, portals or applications. Communications include, but are not limited to, (1) this Consent and any amendments, (2) agreements and contracts, including but not limited to Your home warranty service agreement(s), website and portal terms of use, opt-in agreements, notices, and amendments, (3) policies and notices, including but not limited to the privacy notices required under the Gramm-Leach-Bliley Act and similar federal and state statutes and regulations (You agree that We may satisfy Our obligation to provide You with an initial and annual copy of Our privacy policy by keeping it available for review on www.2-10.com, or, with prior notice to You, on another website), (4) payment authorizations and transaction receipts or confirmations and (5) account statements and history. We may always, in our sole discretion, provide You with any Communication via paper, even if You have chosen to receive it electronically.  There may be certain Communications that by law We are not permitted to deliver to You electronically, even with Your consent.  So long as required by law, We will continue to deliver those Communications to You in writing.  However, if the law changes in the future and permits any of those Communications to be delivered electronically, this Consent will automatically cover those Communications as well.

 

You are considered to have received Communications from 2-10 HBW at the earlier of: (1) when ‎2-10 HBW sends Communications to Your email address, (2) when 2-10 HBW sends Communications via text message, or (3) the first time You access 2-10 HBW’s websites, portals or applications, as applicable, after 2-10 HBW has made the Communications available in such website, portal or application.

 

System Requirements

By providing this Consent, You acknowledge that You can access and retain the Communications. The hardware and software required is a current web browser, an email address, a document reader and access to a computer or a device that can access the internet. To retain the Communications, You must have access to a printer and/or the ability to download the Communications to storage media such as a hard drive or an external media storage device.

 

Paper Delivery of Communications

You have the right to receive Communications in paper form. To request a paper copy of any Communication at no charge, please write to 2-10 HBW, 13900 E. Harvard Avenue, Aurora, Colorado 80014, Attn: Legal Services (“2-10 HBW Address”) within 180 days of the date of the Communication, specifying in detail the Communication You would like to receive. For the avoidance of doubt, requesting a paper copy of any Communication, in and of itself, will not be treated as withdrawal of consent to receive electronic Communications.

 

Withdrawal of Consent to Electronic Communications

You may withdraw Your consent to receive electronic Communications at any time, by writing to the 2-10 HBW Address. You may also be able to withdraw your consent through Our portals.  Any withdrawal of Your consent will be effective after a reasonable period of time for processing Your request, and 2-10 HBW will confirm Your withdrawal of consent and its effective date in writing (either electronically or in paper form).  Depending of the specific Communication for which You are withdrawing consent, We may charge higher or additional fees upon providing notice to You. The legal validity and enforceability of the Communications and Electronic Signatures used prior to withdrawal of Your consent will not be affected. In other words, all prior electronic Communications and Electronic Signatures shall be fully valid and enforceable.

Updating Your Email Address

You can change Your email address by writing to the 2-10 HBW Address. You may also be able to change Your email address yourself through Our portals.

 

YOU ACKNOWLEDGE AND CONFIRM YOUR CONSENT

By clicking the check box next to “E-Sign Consent Agreement”, You acknowledge and confirm that (1) You can access and read this E-SIGN CONSENT AGREEMENT; (2) You can print on paper the disclosure or save or send the disclosure to a place where You can print it, for future reference and access; and (3) until or unless You notify 2-10 HBW as described above, You consent to receive from and through electronic means all notices, disclosures, authorizations, acknowledgements, and other documents that are required to be provided or made available to You by 2-10 HBW during the course of Your relationship with 2-10 HBW.
