Anti-Spam Policy

This Anti-Spam Policy (“Policy”) applies to the use of 2-10 Home Buyers Warranty’s (“HBW”) builder portal e-mail functionality to send e-mails to subcontractors (“Services”). By using the Services you expressly agree to the terms of this Policy.

HBW prohibits the use of the Services in any manner that violates the United States CAN-SPAM Act of 2003 or other similar laws or in any manner that is associated with the transmission, distribution or delivery of any unsolicited bulk or unsolicited commercial electronic communications, including without limitation e-mail (“Spam”). If it is determined that your account is sending, attempting to send, or is associated with a violating account, the account will be terminated.

1. Recipients of E-mail through the Services

Why You Received the E-Mail.

If you received an e-mail by a sender through the Services, it is because a builder has attempted to contact you regarding work relating to a HBW warranty. HBW has created this e-mail functionality so that builders can quickly and easily contact subcontractors for the benefit of those parties.

How to Un-Subscribe.

E-mails generated through the Services include a method for recipients to unsubscribe to future e-mails.  Typically, this feature requires the recipient to click an “Unsubscribe” button in the bottom of the e-mail.

Reporting Violations.

It is never our intention to Spam anyone and we take our anti-spam policies very seriously. If you are the recipient of any suspected violation of this Policy, please e-mail [email protected].

2. Responsibilities of Users of the Services

Use of the Services is subject to the following:

No Spam.

Users of the Services will not send Spam or cause Spam to be delivered to any party.

Privacy Notice and Terms and Conditions.

Use of the Services is subject to all provisions in HBW’s then-current Privacy Notice and Terms and Conditions.

User Credentials

HBW is not liable for any harm related to your disclosure of access credentials, or your decision to allow another person or entity to access and use the Services using your access credentials.

Prohibitions.

Use of the Services is restricted to transactional and/or relationship purposes and cannot contain commercial content. Commercial content advertises or promotes a commercial product or service. For example, you may not include content or a link that is intended for your own commercial purposes in the “Message to subcontractor” box. Transactional or relationship content in this context is using the Services for purposes of providing information to subcontractors about the need for services with respect to HBW warranties.

Users must accurately provide their name and e-mail address and cannot use a non-specific “From” e-mail address, false or misleading names or e-mail addresses, or any other means of misrepresenting the nature of the communication.

Users shall not use the Services to send unsolicited bulk or unsolicited commercial e-mail. The Services are intended to be used only for e-mailing subcontractors who are associated with the subject work.

In addition to the above, the Services may not be used to send e-mails containing:

  • Personal identifying information (e.g., credit card information, social security numbers, etc.)
  • Information that is personal in nature
  • Chain letters
  • Content that promotes, encourages, or engages in terrorism or violence
  • Offers to sell illegal goods or services
  • Harassment, hate speech, or otherwise morally objectionable
  • Information relating to political campaigns
  • Pornography/sexually explicit content
  • Information for products or services from an embargoed or blacklisted country, individual or entity
  • Information that promotes illegal activity

Finally, all users are expected to be aware of, and to comply with, CAN-SPAM.

3. Acknowledgement of Un-Subscribe Procedure

At the end of each e-mail, HBW includes an automatic procedure for an e-mail recipient to unsubscribe from the Services. Any e-mail recipient may unsubscribe at any time and HBW will retain a record of all opt-outs for a period of at least two years. Users agree that they will not use the Services for anyone that they know has unsubscribed.

4. Right to Monitor and Terminate Use

HBW may monitor your account to ensure compliance with these terms and retain copies of all e-mails.  It is the responsibility of the sender to ensure that their content falls within these guidelines. If it is found that the terms of this Policy, the Terms and Conditions or Privacy Notice have been breached, the account may be terminated without notice.

Failure to enforce this Policy in any given instance does not amount to a waiver of any of rights under this Policy or otherwise. Unauthorized use of the Services in connection with the transmission of unsolicited e-mail, including the transmission of e-mail in violation of this Policy, may result in civil, criminal or administrative penalties against the sender and those assisting the sender.
